Understanding the process

How foreclosure actually works in Florida

Florida is a judicial foreclosure state, which means your lender can't simply take your home — they have to sue you in court and win first. That court process commonly takes about 8 to 14 months, and longer if you contest it — so you usually have real time to act. Here's the path it follows, and where you can step in at each stage.

Day 1–90+

Missed payments & late notices

A late fee is added after about 15 days, and your lender will start calling — take those calls. Under federal rules, your servicer generally cannot make the first official foreclosure filing until you are more than 120 days behind, and you'll usually get a “Demand Letter” or “Notice to Accelerate” first. This is the easiest, cheapest stage to fix — call your servicer, a HUD counselor, or us now.

The lawsuit begins

Lis pendens & complaint filed

The lender files a foreclosure lawsuit and records a "lis pendens" (notice of pending suit). You are formally served and typically have 20 days to respond. Responding matters — ignoring it leads to a default judgment.

Months

The court case & your defense

You can answer, raise defenses, request mediation, apply for loss mitigation, or negotiate. Many cases are resolved here through a modification, repayment plan, short sale, or sale before judgment. A foreclosure-defense attorney can challenge the paperwork or the lender's standing.

Summary judgment & sale date set

If the lender prevails, the court enters a judgment and sets a public auction date, usually 30–45 days out. Even now you can often reinstate or sell before the sale to protect your equity and credit.

The home is sold at a public auction. Any equity above what's owed (and costs) may be returned to you as surplus funds — money some homeowners never realize they're owed.

HUD's tips for avoiding foreclosure

The U.S. Department of Housing and Urban Development (HUD) publishes free, official guidance for homeowners at risk. Here are their ten core tips in plain language — the same principles we'll walk through with you. As HUD puts it: foreclosure doesn't happen overnight, and lenders do not want your house.

  1. Don't ignore the problem. The further behind you fall, the harder it becomes to reinstate your loan.
  2. Contact your lender right away. Lenders don't want your house — they have options to help borrowers through hard times.
  3. Open and respond to every letter. Later notices carry legal deadlines; unopened mail is no excuse in foreclosure court.
  4. Know your mortgage rights. Read your loan documents and learn Florida's foreclosure laws and timeframes.
  5. Understand your options. Reinstatement, repayment plans, forbearance, and modification all exist for exactly this.
  6. Talk to a HUD-approved housing counselor. It's free or very low-cost: (800) 569-4287.
  7. Prioritize your spending. After healthcare, keeping your home comes first — trim optional expenses.
  8. Use your assets. Selling a second car or other items to reinstate also shows your lender good faith.
  9. Avoid companies that charge upfront fees. A counselor or your lender provides the same help for free.
  10. Never fall for "rescue" scams. Don't sign over your title or sign anything without professional advice.

How long do I have before I lose my home?
Usually much longer than people fear. Because Florida requires a court case, the process commonly runs many months from the first missed payment to a sale — and you can step in at almost every stage. The sooner you act, the more options stay open. Talk with us or a HUD counselor to map your specific timeline.
Does it cost anything to talk to you?
No. Talking through your situation and options is completely free, with no obligation. Be cautious of anyone who charges an upfront fee to "rescue" your home — that's a common scam. HUD-approved counseling is free by law as well.
Can I still keep my house?
Often, yes. If your income can support a reasonable payment, options like reinstatement, a repayment plan, forbearance, or a loan modification may let you stay. We'll give you an honest read and point you to the right people — even when that isn't us.
Do you only help people who sell to you?
